I will never sell your information. Never.

Any information you enter on this website stays between you and me. If you enter financial information, it will only be saved long enough to complete the transaction, the same with your email address. If you give me your email address in the hopes of receiving a newsletter… I will keep it, but a newsletter is still a long ways away, so I’m not going to be asking for that, except in the context of proving you’re a person, not a bot.

I take privacy seriously, especially as we have so little these days. That said… (See the formulaic provisions below)

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Where we send your data

Visitor comments may be checked through an automated spam detection service.

Terms and Conditions

This website is owned and operated by Elizabeth Clark. When you use this website, you are agreeing to the terms as set out. This website offers original paintings, fine art reproductions, and photographs by Elizabeth Clark. By accessing and using this website, you approve that you have read, understood, and agree to be bound by these Terms.

In order to purchase any products on this website, you need to be at least 18 years of age and posses legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited under any applicable law or regulation applicable to you.

When buying an item, you agree that you are responsible for reading the full item description before making a commitment to buy it, AND that you are entering into a legally binding contract to purchase an item when you complete the check-out payment process.

If you are paying by check, the items will not be sent until the check has cleared, unless you and I have a personal bond in which case you acknowledge my right to name and shame you on social media should you write a bad check.

If you are unhappy with a product, you may return it in its original packaging within 14 days of the purchase date. However, you must communicate with me by email the reason for the return before I will refund your money (minus shipping) via the original method of payment. No refunds will be given on damaged or altered goods unless you can prove they arrived damaged. Reasonable care is taken in packaging all artwork and it is shipped insured.

This website is here by my whims alone. I reserve the right to alter my whims and, therefore, your access at any time with no notice given.

I will take all reasonable care with your information; by using this site, you agree to hold me blameless if everything goes sideways. That includes any mistakes you make, or the extraordinary efforts of bad actors. It also includes honest mistakes of my own, which I will endeavor to make right as is possible. There is an expectation of everyone being reasonable adults who will treat each other with respect. If you aren’t a reasonable adult, or can’t treat me or my work with respect, your permission to use the site is revoked and no fucks will be given.
